An appeal of a recommendation to revoke the license of Griffin-Roughton Funeral Home and its directors, William Roughton and William “Billy” Roughton II scheduled for this week in Austin has been moved to March 2013.
The hearing is an appeal of a 2008 recommendation by the Texas Funeral Services Commission, which is seeking $65,000 in penalties against the Roughtons in connection with a 2007 charge of selling prepaid funeral plans without a required permit from the Texas Banking Commissioner, and not putting the money in a trust account or submitting it to a licensed pre-need insurance company.
The 2007 investigation began with an anonymous phone call and a package of information, also sent anonymously, to the commission, a banking commission official said in the 2008 hearing.
In a statement issue by Roughton’s attorney prior to the scheduled hearing, Steven Grubbs said the Roughtons were looking forward to the hearing.
“Griffin-Roughton Funeral Home and its principals look forward to their day before the Administrative Law Judge when they finally will have an opportunity to share their view of the events made the basis of the Texas Funeral Service Commission’s complaint,” said Grubbs. “The Roughtons are eager to show how they fulfilled their commitments to their customers, as they have done for more than 60 years. They will not allow personal attacks by ‘anonymous’ sources affect their commitment to this community.”
In a filing on Dec. 4, the Roughton’s sought a continuance and have further agreed to a modified procedural schedule for discovery, exhibits, witness lists and objections.
The case is now scheduled to be heard March 4 and 5, 2013, in Austin.
