Grand Jury findings in ‘road rage’ death not released

Corsicana — A Navarro County Grand Jury heard evidence Wednesday regarding the roadside death of an Iowa man after an encounter with an off-duty police Malakoff officer.

But what the Grand Jury decided hasn’t been officially released.

“The grand jury heard evidence on that case, and the results of that will be forthcoming,” Navarro County District Attorney R. Lowell Thompson said following Wednesday’s lengthy session.

William Livezey of Iowa died on Dec. 11, 2013, shortly after a roadside encounter with Ernest Fierro, an off-duty police officer with the Malakoff Police Department in what has been described by witnesses as a “road rage” incident.

Deputies called to the scene of the roadside disturbance on East Highway 31 in Navarro County found the two men on the side of the roadway, with Livezey in handcuffs. When Livezey began to show signs of distress, the deputies removed the handcuffs and began CPR on the Iowa man while awaiting an ambulance. Livezey later died at Navarro Regional Hospital.

An autopsy performed on Livezey by American Forensics lists “hypertensive and atherosclerotic cardiovascular disease” as the cause of death, and ruled the death as “natural.”

Navarro County Sheriff Elmer Tanner called in Texas Ranger investigators to take over the probe since it involved a police officer. The Rangers turned their findings over to Thompson.

In other grand jury actions, two men who led officers from several agencies on a chase and manhunt Christmas Eve were indicted on charges of aggravated robbery and evading arrest.

Donald Atkins and Shamichael White are alleged to have “carjacked” a vehicle from a Seventh Avenue car wash late Christmas Eve afternoon and lead lawmen on a chase through town to the Chatfield area, where they crashed the stolen car and ran on foot. Law enforcement officers from several agencies searched the area until late that night, utilizing a DPS helicopter and TDCJ search dogs, but did not locate the suspects.

A homeowner spotted the two men early Christmas morning and held them at gunpoint until sheriff’s deputies arrived.

Also indicted Wednesday was Drew Walter, charged with cruelty to animals. Walter is alleged to have shot and killed his dog while visiting a Corsicana apartment complex on Jan. 14. He was arrested Jan. 17 in connection with the case.

• Bobby Frazier, possession of a controlled substance over 4 grams and under 200 grams with intent to deliver;

• Shamichael White, aggravated robbery/evading arrest;

• Joe Ayala, possession of a controlled substance over 4 grams and under 200 grams with intent to deliver;

• Latasha Batson, aggravated assault;

• James Beck, DWI, third or subsequent, two counts;

• Thomas Berlin IV, possession of a prohibited substance in a correctional facility;

• Jennifer Blizzard, burglary of a building;

• Charlton Caudill, fraudulent use and possession of I.D. information;

• Brian Caves, possession of a controlled substance under one gram;

• Rebecca Cox, possession of a controlled substance under one gram;

• Arlon Cox, DWI, third offense;

• William Dechaume, possession of a controlled substance under one gram;

• Patrick Davis Jr., DWI, third offense;

• Patricia Hefner, DWI, third offense;

• Randy Lee Hinojosa, Violation of a protective order;

• Billy Howard, possession of a controlled substance under one gram;

• Levi Lebleu, burglary of a building;

• Jerry Lisenbe, bail jumping;

• Javier Martinez, burglary of a habitation, two counts;

• Catherine Mathis, possession of a controlled substance less than one gram;

• Jason Pearson, possession of a controlled substance less than one gram;
